This Web Hosting Agreement is between BoyoHosting and the person/people using our website hosting and domain services. Please read carefully to ensure you understand our terms before purchasing our products or services.

SERVICES

BoyoHosting agrees to provide the stated services at an agreed price at a certain time. We don’t skip key customers with hidden fees unlike many other web hosting companies.

TERMS

All customers are responsible for monitoring their storage space and bandwidth transfers on a monthly basis. Customers who exceed their account limits will be sent an email with the option to increase their account or reduce storage and or storage. If the customer continues to leave, we will do everything possible to fix the problem. We reserve the right to ban accounts for persistent issues. If a customer signs up for an account and cancels it within the first month, they will still be charged for the full first month.

PAYMENTS

Renewal notifications are sent via email three days prior to the actual renewal date on your account. If you use a credit card, you don’t have to worry about manual payments. All accounts are set up on a prepaid basis. If payment is not received within 2 days, a 2% fee will be added. BoyoHosting has the right to change prices at any time, unless other terms have been agreed. Any account that is not updated within a week (7 days) of the email notification or exceeds this timeframe in any way will be suspended. YOU are responsible for all fees owed on the account since the account was established until YOU notify BoyoHosting to request service termination. Even though we are based in INDONESIA, our website currency is USD. YOUR custom billing cycle corresponds to the contract length originally selected during setup. YOUR account will automatically renew during this time unless canceled beforehand. There are no fees for canceled accounts that have been paid annually. If you cancel your account during the monthly billing cycle, BoyoHosting cannot refund any payments made previously.
All annual payments are non-refundable after the 14-day money-back guarantee has passed. You will not get refund if you have problem in license, Ips and other things like cpanel license verification or other license verification on root domain because our price we use all license together. The only time your annual plan will expire is if your account does not comply with our terms of service/acceptable use policy. Monthly and annual payments are non-refundable if your account does not follow our terms of service/acceptable use policy.

CANCELLATION AND EARLY TERMINATION

The customer should acknowledge that the number of services purchased is based on the customer’s agreement to pay a fee for the initial term or renewal term.

Money Back Guarantee

If an account with a 14-day money-back guarantee is purchased and canceled within 14 days of signing up, the Customer will, upon request, receive a full refund of all hosting fees. This refund request must be made through our Billing Team. Refunds made for a 14-day money-back guarantee will not include domain registration fees, setup fees, license fees, or any fees for additional services purchased within the first 14 days. Money Back Guarantee only applies to new clients. Spammers, Hackers and other clients who try to do illegal things will not be refunded.

SERVER ABUSE

Any attempts to damage or harm BoyoHosting’s servers or customers are strictly prohibited.
BoyoHosting will react strongly to any use or attempt to use an Internet account or computer without the owner’s permission. Such attempts include ‘Internet Fraud’ (tricking others into releasing their passwords), password theft, scanning for security holes, etc.
Any unauthorized use of an account or computer by YOU, whether the account or computer that was attacked belongs to Your Company or not, will result in action against YOU. Possible actions include warning, suspension or cancellation of accounts, as well as civil or criminal legal action, depending on the seriousness of the attack.
IMPORTANT NOTE – BoyoHosting has the right to stop the service, or deny access to anyone who violates our policies or the terms and conditions shown below WITHOUT WARNING or PRIOR NOTICE. There will be no refund of fees paid if the account termination is caused by a violation of the terms outlined below.
YOU may not run IRC, bots, or clients on a shared server. Unacceptable uses also include, but are NOT limited to: Bulk email, unsolicited email, newsgroup spam, upload scripts (Rappidleach), pornographic content, illegal content, copyright infringement, trademark infringement, warez sites (including links to/from), crack, software serial number, proxy-relay, link farming (action or by using script), link milling, link only sites, spamdexing, FFA (Free For All) and/or whatever is specified by BoyoHosting unacceptable use of our services including misuse of server resources.
WEB APPLICATIONS AND WEB ACCESSIBLE SCRIPS – All out-of-date and actively exploited web applications will be closed immediately without prior notice. YOU are responsible for and should regularly evaluate YOUR web-based applications and scripts to ensure their safety and properness.
A shared hosting account may also be terminated if it contains the following content or has links to the following content: Provides material that is highly offensive to the Web community including flagrant expressions of bigotry, racism, hatred, or words -profanity; promote or provide instructional information about illegal activities; promote physical harm or injury to any group or individual; displays material containing obscene nudity or pornographic material (not applicable to dedicated managed servers); displays material that exploits children under the age of 18; acts of copyright infringement including offering pirated computer programs or links to such programs; information used to circumvent manufacturer-installed copy protection software, including serial numbers or registration numbers for software programs, or any type of cracker utility.

DISK SPACE ABUSE

BoyoHosting will be the sole arbiter regarding what constitutes a violation of these provisions. You are responsible for monitoring your disk space usage. If you need extra disk space, contact one of our staff and they will be more than happy to help. You can also upgrade your hosting package from within your BoyoHosting client account.

BANDWIDTH ABUSE

The goal of BoyoHosting is to provide large bandwidth for transferring web documents, and not an off-site storage area for electronic files. If YOU violate these terms, YOU will be notified and given 48 hours to resolve the matter. Failure to do so will result in YOU being billed for overage.
Traffic will be untracked until YOU reach the quota amount allocated for YOUR specific PLAN. BoyoHosting will be the sole arbiter regarding what is a violation of this provision.

CUSTOMER INFORMATION

Customers represent and guarantee to BoyoHosting that the information they have and will provide to Your Company for the purpose of building and maintaining services is accurate. If the customer is an individual, the customer represents and warrants to BoyoHosting that he or she is at least 18 years old. Your company may rely on instructions from the person listed as the Primary Customer Contact on the Order in connection with the Customer’s account until the Customer provides written notification to amend the Main Customer Contract.

UNSOLICITED EMAIL & SPAMMING

Unsolicited commercial advertising (‘SPAM’) is not allowed in emails, and may result in account cancellation. Your company takes a zero tolerance approach to SPAM originating from its servers or to spam advertisements from domains hosted on our network. If found, YOUR account may be deleted.
The following activities are not allowed: SPAM, which includes, but is not limited to, mass sending of commercial advertisements, information announcements, solicitations of charity, signature petitions, and political or religious tracts ( the message can only be delivered to those who have explicitly requested it from your domain); Forging, changing, or deleting e-mail headers – any domain sending surreptitious spam will be terminated without warning and without a refund. Sending multiple copies of the same or substantially similar message with the intent to disrupt servers or accounts (‘mail bombing’); Spamming Newsgroups: Commercial advertising is frowned upon in most Usenet discussion groups and on most email mailing lists. Inappropriate posting may result in account cancellation. Check the newsgroup or mailing list charter to find out whether advertising is allowed or not. Sending messages to multiple newsgroups is off-topic, highly unethical and will be treated as such; Letters should not be used to harass or intimidate other people. Harassment, whether through language, message frequency, or message size, is prohibited. Sending one unsolicited message may be considered harassment. If the recipient requests to stop receiving emails, YOU may not send further messages to that person.
NOTE – If YOU use services from other providers to promote websites hosted by or through BoyoHosting (‘spamvertising’), the above policy terms will apply as if SPAM was sent through our server.

99.99% UPTIME GUARANTEE

(1.) COVERAGE – This 99.99% uptime guarantee applies to any Customer in good financial standing with BoyoHosting at the time of service termination.
(2.) SERVICE LEVEL AGREEMENT (‘SLA’) & SPECIFICATIONS – BoyoHosting strives to make YOUR website content available for http access by any party in the world 99.99% of the time. Network downtime (‘unavailable’) is defined as 100% packet loss from BoyoHosting to its backbone provider. Downtime is measured after 10 minutes after notification of network failure via the BoyoHosting online ticketing system. If the ticketing system itself cannot be reached, tickets must be initiated by contacting other BoyoHosting support channels such as whatsapp or email.
BoyoHosting’s NOC will determine the end of the downtime with a traceroute to YOUR machine from outside your Company network.
No credit will be issued to YOU if you experience an outage due to:
– scheduled maintenance as posted from time to time on BoyoHosting,
– your behavior or the performance or failure of your equipment, facilities or applications,
– circumstances beyond your Company’s reasonable control, including, without limitation, acts of government agencies, war, mutiny, sabotage, embargoes, fires, floods, strikes or other labor disturbances, transportation disruptions or delays, unavailability of interruptions or delays in telecommunications or services third parties, including DNS propagation, domain name registration/transfer, failure of third party software or hardware or inability to obtain the raw materials, supplies, or used power or equipment necessary for the provision of your website,
– if YOU violate any of the agreement policies in the ‘Terms & BoyoHosting’s terms and AUP’ which caused the machine to fail as a result.

TECHNICAL SUPPORT BOUNDARIES

BoyoHosting provides technical support for YOU that only covers our areas of expertise. Such expertise includes assisting, troubleshooting, and debugging our cPanel control panel interface, servers under our direct responsibility, and other hosting-related issues.
Unlike many hosting companies We do our best to help with scripts, templates and programming languages. However, under no circumstances is Your Company obligated to assist YOU in the installation of new application modules, templates and/or programming languages, or in providing assistance for any errors generated by any application that You have previously modified.

CGI SCRIPTS

Each shared web hosting account comes with its own CGI-BIN. YOU are free to use any CGI scripts YOU wish, however we reserve the right to disable any CGI scripts affecting the normal operation of a shared server without prior notice.

INDEMNIFICATION

The customer agrees to indemnify and release BoyoHosting, BoyoHosting affiliates, and their respective officers, directors, agents and employees from and against any and all claims, demands, obligations, liabilities, losses, damages, penalties, fines, damages, amount of interest, expenses and expenses of any kind and nature (including reasonable attorneys’ fees) brought by third parties under any theory of legal liability arising out of or related with the actual or suspected use of the Customer’s services in violation of applicable law or the Customer or anyone using the Customer’s login information, regardless of whether such person has been authorized to use the service by the Customer.
YOU AGREE TO DEFEND, INDEMNIFY AND KEEP BoyoHosting’S RISK AGAINST THE LIABILITY ARISING OVER:
(1) ANY INJURY TO PERSON OR PROPERTY CAUSED BY PRODUCTS SOLD OR DISTRIBUTED IN CONNECTION WITH YOUR COMPANY SERVERS.
(2) ANY MATERIAL PROVIDED BY THE CUSTOMER VIOLATES OR ALLOWS ANY THIRD PARTY PROPRIETARY RIGHTS
(3) COPYRIGHT INFRINGEMENT AND
(4) DEFECT PRODUCTS SOLD TO CUSTOMERS FROM BoyoHosting SERVERS.

DISCLAIMER OF WARRANTIES

BoyoHosting does not guarantee or represent that the service will be uninterrupted, error free, or completely secure. To the fullest extent permitted by applicable law BoyoHosting disclaims any and all warranties including the implied warranties or merchantability, fitness for a particular purpose and non-infringement. To the maximum extent permitted by applicable law, all services are provided on an “As Is” basis.
